1111 GENERAL CONDITIONS:

1.1. The general conditions for sales and carriage Everest routes describe the conditions for service, custom clearance and carriage of passengers, luggage and goods according to Decree No. IV of the Transportation Regulations.
1.2. The general conditions concern the licensed international carriages provided by partner carriages companies.
1.3. The tickets sale is provided by the carrier sales agents.
1.4. The interpretation of certain expressions:
a)
The carrier – should be understood as a licensed company providing the carriage of persons, luggage and things;
b) The passenger – should be understood as a person who uses a valid ticket with his name on it;
c) Luggage -  should be understood as a portable thing which is taken by the passenger and meets the carriage conditions;
d) A ticket – should be understood as the document which includes the stated route, price and the date of the journey and entitles the passenger to carriage.
e) Tariffs – the current charges for carriage, luggage and reductions fare;

1122 THE CARRIER:

2.1. The carrier’s responsibilities:
a) the carriers is obliged to carry the passenger and his luggage from the station where he boards to the station which is defined as the destination;
b) provide the other mean of transport on case of the breakdown of the vehicle;

2.2.The carrier assures to transport the passengers and their luggage on time if there are no obstacles. The time of arrivals and departures may change, they are not guaranteed and they are not a part of the contract between the carrier and the passenger.
2.3. The carrier is not responsible for the delays or journey cancellations when they are caused by: the closure of the borders, the elements or the other impediments so that the journey is not possible.
2.4. If necessary, the carrier can choose the other carriers, change the vehicle or the destination.
2.5. If the passenger:

a) does not follow the carriage regulations;
b) consumes alcoholic beverages or some psychotropic or neurotic substances and shows symptoms of drunkenness;
c) has some symptoms of illness which can be a menace to the other passengers;
d) is burdensome for the other passengers;
e) does not posses the required documents needed for crossing the border or does not follow the border regulations, or is not allowed to enter the country by the passport authorities;
f) does not posses the required documents needed for crossing the border or does not follow the border regulations, or is not allowed to enter the country by the passport authorities;

2.6. The carrier is entitled to refuse the carriage and to keep the ticket of the passenger who possessed the ticket illegally or does not posses any documents which corresponds to the information on the ticket.
2.7. The carrier is not responsible for mistakes concerning the passenger’s faults including giving the wrong address.

1133 THE PASSENGER:

3.1. The passenger shall:

a) have the valid ticket and all the necessary documents required in the custom clearance;
b) wait on the station where he boards the vehicle on the time stated in the timetable;
c) show the valid ticket to the carrier;
d) put the luggage in the vehicle’s luggage compartment and pay for the additional luggage;
e) concern the members of the carrier’s staff instructions and orders;
f) show the documents to the customs and passport authorities;
g) give the exact address (including the post code, street name and number, the name of the city and the country) according the spelling rules of the destination country.

3.2. Because of the regulations applicable in transit or destination countries persons under the age of 12 can be carried on service only accompanied by an adult. The persons between the age of 12 and 16 need to have a permission signed up by both parents or the legal guardian and by a notaries.
3.3. If the passenger does not wait on the boarding station at the time stated in the timetable it is understood as a resignation from the carriage.
3.4. The passenger shall fasten the seat belts.
3.5. Smoking and consuming alcoholic beverages on the board of the vehicle is prohibited.
3.6. The passengers are responsible for watching the length of the breaks announced beforehand during the journey on order to avoid any delays.
3.7. The carrier’s insurance covers the insurance events which occur during the journey only on the board of the vehicle. Any other harms are not covered by the insurance of the carrier.
3.8. The passenger is responsible for any damages and harms which he does to the carrier or the other passengers.

1144 THE LUGGAGE:

4.1. The passenger can take two items of luggage, which is included into the ticket price;

a) one item of the luggage in maximum dimension of 25x55x80 and the maximum weight of 25 kilos;
b) one item of hand luggage in maximum weight of 5 kilos;

4.2. The hand luggage shall be put under or above the passenger’s seat and do not cause any interference by its dimension.
4.3. The luggage which exceeds the weight and dimension can be carried as an additional luggage under the relevant provisions.
4.4. The passenger can take one additional item of travelling luggage under the relevant provisions but the weight of the two items of travelling luggage cannot exceed the weight of 35 kilos.
4.5. The carrier is entitled to refuse to carry the luggage which does not meet these regulations.
4.6. Things which can cause any damage to the vehicle or harm to the passengers’ lives or health or their properties cannot be luggage.
4.7. The carrier or the persons representing the carrier are entitled to consider the carriage of additional luggage.
4.8. The carrier is not responsible for the hand luggage and the things which are not placed in the luggage compartments.
4.9. Every item of travelling luggage shall be tapped with a name and address of the passenger.
4.10. It is prohibited to carry the things which are prohibited in other regulations.
4.11. In the line with the provisions of the Section No. 23 of the Decree No. 3 of the Transportation Regulations, the carrier or the members of the carrier’s staff can search the luggage when there are some evidence that it does not meet these regulations.
4.12. The carrier or the members of carrier’s staff can remove the luggage out of the car it is not attached to any particular person.
4.13. The passenger is fully responsible for the hand luggage placed above, under, next to, in front of or behind(only for the back row) his seat during the controlling the vehicle by the passport and custom authorities.
4.14. The carriage of animals is strictly prohibited.
4.15. The relevant provision for the additional luggage is charged by the members of carrier’s staff and may oscillate between 20-100 PLN for one item which depends on the weight and dimension of the luggage.

1155 THE TICKET:

5.1. The ticket is a document which entitles the passenger to the carriage.
5.2. The ticket is sold by the carrier’s sales agents in the stated places.
5.3. The types of tickets:

a) one-way- ticket is a document which contains the date of departure and entitles the passenger to the journey from the place where he borders the vehicle to the place of destination;
b) return ticket – the document which contains the date of departure and the return journey. It is valid for 2 months from the date of the first journey stated in the ticket;
c) a ticket with an open return – it is a document which contains only the date of departure. The return journey needs to be taken within 2 months from the first journey. The passenger shall make the reservation for the return journey;

5.4. The ticket is valid when it contains:

a) the passengers name;
b) the business name of the carrier;
c) the amount of the fare;
d) the seal of the agent who sells the ticket;

5.5. Changes to tickets.

a) all the changes can be made in the place where the ticket was purchased, in the sales agent’s office, the carrier’s partner’s offices or in the Centre of Reservation;
b) the date or an hour of the departure can be changed up to 4 weekdays before the departure time;
c) a ticket can be transferred only by the agents who needs to have the carrier’s permission. The name on the ticket must to be printed when it is changed, The ticket is invalid when the information on the ticket has been changed without an authorization;
d) all the changes need to be signed and sealed by the sales agent, if these regulations are not followed the ticket will be invalid;
e) it is not possible to make any changes on the day of departure;
f) the charges for the changes are fixed and can be checked in the carrier’s or sales agent’s office;

5.6. The ticket is invalid if it has been damaged to such an extent that the information needed to check its correctness is eligible.

1166 RESERVATIONS:

6.1. The passenger can buy a ticket one month before the date of departure.
6.2. Reservation without buying the ticket is not possible.
6.3. Information about the charges and the reservation of the tickets with an open return can be found in the sales agents’ offices and at the members of the carrier’s staff.

1177 REFUNDING A FARE

7.1. . The ticket can be returned to the office where it was purchased before the departure. However it can not be damaged and it needs to be returned with a receipt.
7.2. If the ticket is returned more than 4 days before the departure, the amount of cancellation fee is 90 %  of the cost of the fare. If the ticket is returned less than 4 days before the departure the amount of cancellation fee is 50 % of the cost of the fare. The exception is for the group of persons with an individual travel conditions. The refund is done in the lace of purchasing the ticket.
7.3. The amount of cancellation fee for the cancellation of the return journey is the same as in  point 7.2 of this regulation.
7.4. . The carrier does not refund the fare for the journey which is shorter than one-way or when the passenger is refused to border or to continue the journey under the circumstances mentioned in point 2.5 of this regulation.
7.5. The carrier does not refund the fare for the ticket which:

a) has been damaged in such an extent that the important information is eligible;
b) is stolen or lost;
c) has not been used but the journey is cancelled on the day of departure;
d) has been used only as a one-way ticket (this regulation concerns return ticket only);
e) all the changes are charged with 15% of the amount of the fare;

7.6. If the passenger’s resignation is cause by the carrier, the charges are not used.

1188 TARIFFS:

8.1. The fare is defined on the basis of the tariffs which are applicable on the day of the ticket sale. The fare shall be paid in the currency of the country where the ticket is purchased. The applicable tariffs are available at the sales agents’ offices and at the members of carrier’s staff.

1199 CLAIMS:

9.1. Every claim shall be filled in writing or by an e-mail letter to the carrier’s address or to the sales agent’s office where the ticket was purchased.
9.2. Every claim should be delivered no later that 30 days after the event. Every claim with an attached ticket or the copy of the ticket, shall include the description of the event and harms. The carrier will deal with the claim within 30 days from the receipt.
9.3. In the case when the claim relates to the loss of luggage or any personal harms, the claim shall be presented by the passenger or the person who represents him in the name of the law.
9.4. The claims referring to the luggage which is carried in the luggage compartment shall be made to the members of the carrier’s staff and confirmed by him.
9.5. The luggage which is left in the luggage compartment will be stored for no longer that 2 months. After that period of time the thing which it contains will be auctioned. The passengers shall cover the costs of the storage of their luggage.
9.6. The carrier is not responsible for the things left in the vehicle after the arrival.
9.7. Compensation for the lost luggage cannot exceed the amount of 1.000.00 PLN or the equivalent of this amount of money in EURO. When the worth of the luggage exceeds 1.000.00 PLN the passenger is advised to take an extra insurance.

11010 THE DOSING REGULATIONS:

10.1. In all the cases not mentioned in these regulations the following procedure shall be taken into account:
a) ustawa z dnia 15 listopada 1984 r. prawo przewozowe (Dz. U. z 2000 r. nr 50, poz. 601; z póŸn. zmianami;
b) ustawa z dnia 23 kwietnia 1964 r. kodeks cywilny (Dz. U. z 1964 r. nr 16, poz. 93; z póŸn. zmianami)

10.2. All these regulations become valid on 1st April 2004.
